VDOT Memorandum Anticipates Uplisting of Tricolored Bat

VDOT's Environmental Division has released a memorandum with an update on the U.S. Fish and Wildlife Service's (USFWS) proposed listing of the tricolored bat (TCB) as "endangered" under the Endangered Species Act (ESA). The proposed listing, like the recently uplisted Northern Long Eared Bat, will have impacts on VDOT projects that receive federal funds or require federal permits.

USFWS is expected to announce the TCB listing decision in mid-September. To prevent project delays or coordination issues, VDOT's Environmental Division has recommendations and is taking proactive measures anticipating the uplisting of the bat. 

USFWS is working to finalize rules and consultation tools to implement the ESA changes related to TCB. VDOT’s memorandum notes that existing guidelines may restrict the use of emergence surveys for projects involving TCB, impacting project progress. Until the effective date of the TCB listing decision VDOT staff may continue emergence surveys and USFWS may approve such surveys on a case-by-case basis afterward.

While specific timelines and details are unavailable, updates will be provided as they become known. In the meantime, VTCA will continue to monitor and evaluate developments closely and provide updates as they are made available.
